The Digital Health Act, 2023: what it means for you as a patient

The Digital Health Act, 2023 makes e-health, including mobile health apps and telemedicine, a recognised way of delivering health care in Kenya. It established the Digital Health Agency, which certifies digital health solutions, and it gives you rights to see, receive, correct and in some cases erase your health information.

Is a health app a real way to get care under the law?

Yes. Section 40 recognises e-health as a model of health service delivery that complements existing services, and section 41 lists m-health and telemedicine among e-health services.

Who can provide e-health services?

Under section 41, licensed health care providers and facilities licensed by the relevant regulatory body, or recognised equivalents for foreign providers.

What rights do I have over my health data?

To examine and receive a copy of your personal health information on written request (section 36), and to ask for inaccurate data to be corrected or unlawfully held data to be erased (section 39).

What does the Digital Health Agency do?

Among its functions in section 6: building Kenya's Comprehensive Integrated Health Information System, promoting shareable and portable personal health records, and certifying digital health solutions.
